Bespoke Story Service Agreement
1. Parties
This Agreement is between:
• Lyrical Pictogram (“we”, “us”, “our”), a provider of bespoke creative writing services; and
• The Client (“you”, “your”), the person commissioning a bespoke story.
By placing an order, you agree to be bound by this Agreement together with our Terms & Conditions and Privacy Policy.
2. Service description
2.1 Nature of the service
We create a bespoke written story (“Final Work”) inspired by:
• A personal photograph you submit; and
• Your answers to our questions and/or conversation between us (“Customer Materials”).
The Final Work is an original, interpretive narrative, not a factual or biographical record.
2.2 No therapeutic or advisory service
The service is artistic and creative. It does not constitute therapy, counselling, psychological assessment, or professional advice.
3. Customer materials
3.1 Ownership and rights
You confirm that:
• You own the photograph or have permission to use it.
• You have the right to share it with us for creative purposes.
• Any individuals depicted have consented to its use in this context.
• Customer Materials do not infringe third‑party rights or contain unlawful content.
3.2 Licence to use
You grant us a limited licence to use the Customer Materials solely to create the Final Work and to manage your order.
3.3 Sensitive content
If Customer Materials contain sensitive or emotionally charged content, you acknowledge that the Final Work may reflect those themes in a creative manner.
4. Scope of work and additional work
4.1 Scope of work
The scope of the project (length, format, tone, any specific focus) will be set out in the order confirmation or project brief. Anything not expressly included is out of scope.
4.2 Additional work
The following are treated as new, chargeable work:
• Alternative versions of the story
• Major structural changes or complete rewrites
• New concepts or directions not agreed at the outset
Additional work will be quoted separately and undertaken only with your written agreement.
5. Fees, payment and delivery
5.1 Fees and payment
The fee for the service is stated at the point of purchase. Payment is due in advance unless otherwise agreed.
5.2 Refunds
Because the service is bespoke and personalised, refunds are not generally offered once work has begun, except where required by consumer law. We may, at our discretion, offer partial or full refunds in exceptional circumstances.
5.3 Delivery
We will deliver the Final Work in the agreed format of a printed copy by the estimated delivery date. This date may be adjusted if you delay in providing Customer Materials or responses.
6. Intellectual property and usage rights
6.1 Ownership
We retain full copyright and intellectual property rights in the Final Work and all drafts, notes, and exploratory materials, unless explicitly assigned in a separate written agreement.
6.2 Licence to use
Upon full payment, you receive a limited, non‑exclusive, non‑transferable licence to use the Final Work for personal, non‑commercial purposes (e.g. private reading, gifting, display in your home).
Any commercial use (publication, performance, sale, or promotional use) requires our prior written permission and may incur additional fees.
6.3 Restrictions
You may not:
• Publish or distribute the Final Work
• Use the Final Work for AI training or automated content generation
• Remove or alter authorship credit where it is displayed
• Sell, license, or otherwise exploit the Final Work commercially without agreement
7. Portfolio and confidentiality
7.1 Portfolio use
We may, with your consent, display the Final Work (or an excerpt) in our portfolio, website, or promotional materials. You may refuse or withdraw consent at any time, and we will remove the work within a reasonable period.
7.2 Developmental materials
Drafts, notes, and behind‑the‑scenes creative materials will not be shared publicly without your explicit written permission.
7.3 Confidential projects
If you request full confidentiality, we will not use your Final Work or Customer Materials in our portfolio or marketing.
8. Data protection
We will handle your personal data, including photographs and written information, in accordance with our Privacy Policy and applicable data protection law (UK GDPR and Data Protection Act 2018).
You may request deletion of your Customer Materials after completion of the project, unless retention is required for legal or accounting reasons.
9. Limitation of liability
To the fullest extent permitted by law:
• We are not liable for indirect, incidental, or consequential loss.
• Our total liability in relation to any project is limited to the amount you paid for that project.
• You acknowledge that creative outcomes are subjective and that satisfaction cannot be guaranteed in a strictly objective sense.
10. Governing law and disputes
This Agreement is governed by the laws of England & Wales.
Any dispute arising from or in connection with this Agreement will be subject to the exclusive jurisdiction of the courts of England & Wales.
11. Acceptance
By placing an order, making payment, or confirming your project in writing, you acknowledge that you have read, understood, and agree to:
