4. Scope of Work

Scope of Work — The services provided (“the Work”) encompass bespoke creative development, writing, dramaturgical analysis, narrative architecture, editorial refinement, and conceptual consultancy as described in the project brief, proposal, or contract issued prior to commencement. The Scope of Work includes only the tasks, deliverables, and objectives expressly stated in that document. Any activity not explicitly listed is considered out of scope.

The Work may include:

• Creative Development — ideation, thematic exploration, structural mapping, character psychology, voice development, tonal calibration, and conceptual refinement.

• Writing & Editorial Craft — drafting, redrafting, line‑editing, structural editing, narrative tightening, and stylistic enhancement.

• Dramaturgical Consultancy — analysis of narrative coherence, pacing, emotional logic, character motivation, thematic resonance, and audience impact.

• Creative Strategy — guidance on project direction, conceptual positioning, voice development, and long‑form creative planning.

• Client Collaboration — scheduled discussions, feedback sessions, and clarifications necessary to progress the Work.

Boundaries of the Scope

The Scope of Work does not include:

• Unlimited revisions or rewrites

• Additional concepts beyond those agreed

• Research exceeding the agreed depth or duration

• Formatting, typesetting, or production‑ready preparation unless specified

• Legal, marketing, or technical advice outside creative expertise

Additional Work

Any request that alters the agreed Scope — including new scenes, additional chapters, expanded dramaturgical analysis, substantial rewrites, accelerated timelines, or new conceptual directions — will be treated as Additional Work. Additional Work will be quoted separately and may affect delivery dates. No Additional Work will begin without written confirmation from the client.

4A. Bespoke Story Service Based on Customer‑Submitted Materials

Bespoke Story Service — Our core service involves creating a bespoke written story inspired by a personal photograph submitted by you, together with answers to questions we provide and/or conversation conducted between us (“Customer Materials”). The resulting story (“the Final Work”) is an original creative interpretation, not a factual account, and may include imaginative, symbolic, or narrative elements.

4A.1 Customer Materials

By submitting Customer Materials, you confirm that:

• You own the photograph or have permission to use it.

• You have the right to share the image with us for creative purposes.

• Any individuals depicted have consented to the image being used in this context.

• The materials do not infringe third‑party rights or contain unlawful content.

You grant us a limited licence to use the Customer Materials solely for the purpose of creating the Final Work.

4A.2 Creative Interpretation

You acknowledge that:

• The Final Work is a creative, interpretive narrative, not a literal or biographical representation.

• We may incorporate symbolism, metaphor, emotional inference, or imaginative expansion.

• You are commissioning an artistic response, not a factual service.

4A.3 Boundaries of the Service

The service does not include:

• Photographic editing, enhancement, or analysis

• Psychological assessment or personal advice

• Factual verification of any information provided

• Unlimited rewrites or alternative versions

• Any use of Customer Materials beyond the creation of the Final Work

4A.4 Sensitive Content

If your photograph or answers contain sensitive, private, or emotionally charged material, you acknowledge that the creative interpretation may reflect those themes. You may request in writing that the Final Work remain private and not be used in our portfolio (see Section 10).

4A.5 Removal of Customer Materials

You may request deletion of your submitted photograph and associated materials after the Final Work is delivered. We will comply unless retention is required for legal or contractual reasons.

5. Intellectual Property & Usage Rights (Strengthened)

Intellectual Property — All creative work produced by us—including but not limited to concepts, narrative structures, dramaturgical analysis, character psychology, thematic frameworks, drafts, edits, treatments, reports, and any form of written or conceptual development (“the Creative Material”)—is and remains our exclusive intellectual property unless expressly transferred in writing.

5.1 Ownership

We retain full copyright and all associated intellectual property rights in:

• Original creative work

• Drafts, redrafts, and exploratory material

• Narrative architecture and dramaturgical frameworks

• Editorial refinements and structural interventions

• Creative strategy, conceptual direction, and thematic development

No transfer of ownership occurs unless a separate written agreement explicitly assigns rights.

5.2 Licence to Use

Upon full payment, you receive a limited licence to use the final approved deliverables (“the Final Work”) for the specific purpose defined in the project brief or contract.

This licence is:

• Non‑exclusive

• Non‑transferable

• Non‑sublicensable

• Restricted to the agreed purpose only

Any additional usage—including commercial expansion, adaptation, derivative works, publication, performance, or distribution beyond the agreed scope—requires a new written licence and may incur additional fees.

5.3 Restrictions

You may not:

• Reproduce, distribute, or publish drafts, exploratory work, or unused concepts

• Create derivative works from any Creative Material not included in the Final Work

• Remove, obscure, or alter authorship credit

• Use the Creative Material for AI training, dataset creation, or automated content generation

• Sell, license, or transfer the Creative Material to third parties without written permission

5.4 Drafts, Exploratory Work & Unused Concepts

All drafts, sketches, notes, analyses, treatments, and unused concepts remain our property.

They are provided solely for the purpose of collaboration and cannot be used, shared, or repurposed without explicit written permission.

5.5 Moral Rights

We assert our moral rights under the Copyright, Designs and Patents Act 1988, including:

• The right to be identified as the author

• The right to object to derogatory treatment of the work

These rights remain in force unless expressly waived in writing.

5.6 Client‑Provided Materials

You warrant that any materials you supply (text, images, references, research, etc.) do not infringe third‑party rights.

You grant us a licence to use such materials solely for the purpose of completing the Work.

6. Client Responsibilities

You agree to:

• Provide accurate information and materials needed for the project

• Respond to communication in a timely manner

• Ensure you have the rights to any materials you supply

You indemnify us against claims arising from materials you provide.

7. Delivery Model & Client Responsibilities

Single‑Pass Delivery
The Work is produced using a single‑pass creative and editorial process. All materials are developed, refined, and completed internally prior to delivery. Drafts, previews, or iterative development stages are not provided unless expressly agreed in writing as part of the Scope of Work.

Client Responsibilities
To ensure the Work aligns with the agreed objectives, the client is responsible for providing all necessary information, materials, references, and direction before work begins. This includes:

• Comprehensive answers to the information requested
• Tone and style considerations
• Any mandatory inclusions or exclusions
• Relevant background materials or source content

Information provided after work has commenced may require Additional Work.

Final Delivery
Upon delivery, the Work is considered final. Any changes, edits, or adjustments requested after delivery — regardless of scale or reason — are treated as Additional Work and quoted separately.

Additional Work

No Additional Work will begin without written confirmation from the client.

8. Fees, Payment & Non‑Refundability

Fees & Payment
All fees are quoted in GBP and confirmed before work commences.
Fees are payable in full prior to the start of any work. Work will not begin until payment has been received and cleared.

Non‑Refundable Fees
All fees are non‑refundable, including in circumstances where the client chooses to cancel, pause, or discontinue the project for any reason. This reflects the allocation of time, scheduling, and professional commitment reserved exclusively for the client.

Invoices & Late Payment
Where invoices are issued, they are payable within the stated timeframe. Late payments may incur interest under the Late Payment of Commercial Debts (Interest) Act 1998.

Cancellation by the Client
If the client cancels a project after payment has been made, no refund is due. Any additional work requested following cancellation will be quoted separately.

9. Delivery of Work

We will deliver final work in the agreed format.

Delays caused by your failure to provide a correct delivery address are not our responsibility.

We are not liable for delays caused by external factors beyond our control.

10. Portfolio Use

Portfolio Use — We may display the Final Work in our portfolio, website, social channels, or promotional materials to demonstrate our creative practice, unless you request otherwise in writing. “Final Work” refers exclusively to the approved deliverables supplied at project completion.

10.1 Protection of Developmental Materials

Drafts, exploratory work, dramaturgical analysis, structural maps, character psychology notes, thematic frameworks, and any other developmental or behind‑the‑scenes Creative Material will never be displayed, shared, or referenced publicly without your explicit written permission.

10.2 Sensitive or Private Projects

If your project contains confidential, unpublished, or sensitive material, you may request in writing that no part of the Final Work be displayed publicly. We will honour such requests without exception.

10.3 Anonymised Portfolio Use

Where appropriate, we may reference the nature of the Work in an anonymised or generalised form (e.g., “narrative consultancy for a stage production”) without disclosing identifying details, unless you request full confidentiality.

10.4 Withdrawal of Permission

You may withdraw permission for portfolio use at any time. Upon written request, we will remove the Final Work from public display within a reasonable timeframe.

11. Limitation of Liability

To the fullest extent permitted by UK law:

• We are not liable for indirect, incidental, or consequential damages

• Our total liability for any claim is limited to the amount paid for the specific project

• Creative outcomes are subjective; we do not guarantee specific results

12. Governing Law

These Terms are governed by the laws of England & Wales.

Disputes will be resolved exclusively in the courts of England & Wales.
